If you are a single person with an estate worth over £25,000 and you die without having written a Will, your entire estate is liable to be distributed under the Rights of Succession. This refers to anyone who is not married, regardless of whether you live with your partner or not. Without making a Will, your partner will NOT receive a thing.
In the following priority order, your entire estate will go to:
- Children (if any)
- Your parents
- Siblings (or their children)
- Grandparents
- Uncles and Aunts (or their children)
Not making a Will, whilst these conditions apply, can cause a substantial amount of distress to family in claiming possessions, and a lot of money can be lost in the process.
